Welcome to Atart.
These Terms of Service govern your access to and use of the Atart mobile application, including AI-assisted creative tools, updates, and related services. By using Atart, you agree to these Terms and our Privacy Policy. If you do not agree, you must stop using the Service.
1. Key Definitions
- "Atart", "App", or "Service" means the mobile application, software, features, updates, content, and related services we provide.
- "User", "you", and "your" mean any person who installs, accesses, or uses Atart.
- "User Content" means prompts, uploads, media, text, files, settings, and other materials submitted or created through the Service.
- "Terms" means this agreement and any policies or notices incorporated into it.
2. Eligibility
Atart is not intended for children under 13. If you are at least 13 but under the age of legal majority, you may use the Service only with permission from a parent or legal guardian. You are responsible for ensuring your use is lawful where you live.
3. App Store Distribution
Atart may be distributed through Apple's App Store. Your download, purchase, subscription, refund, and device use may also be subject to Apple's terms, rules, and policies. Apple is not responsible for maintaining or supporting Atart unless required by applicable App Store rules.
4. Use of the Service
You may use Atart only for lawful personal, creative, and permitted purposes. You agree not to interfere with the Service, bypass security controls, access systems without authorization, reverse engineer restricted components, or use Atart in a way that violates laws or third-party rights.
5. User Content and Generated Output
You are responsible for the materials you submit and for any output you use, publish, or share. You must have the rights needed for uploaded content. AI-generated results may be inaccurate, incomplete, unexpected, or similar to results created for other users, and should be reviewed before use.
6. Privacy
Our handling of information is described in the Atart Privacy Policy. That policy is incorporated into these Terms and should be reviewed together with them.
7. Third-Party Services
Atart may depend on app stores, payment processors, hosting providers, analytics tools, advertising partners, AI processing services, diagnostics providers, and other third parties. Their own terms and policies may apply. We are not responsible for services or websites we do not operate.
8. Intellectual Property
Atart, including its software, interface, design, branding, text, systems, and technology, is owned by us or our licensors. These Terms give you a limited, revocable, non-transferable right to use the Service as intended, but do not transfer ownership of Atart.
9. Prohibited Conduct
- Do not create, upload, or distribute unlawful, abusive, deceptive, exploitative, infringing, or harmful content.
- Do not harass, impersonate, defame, threaten, or violate another person's privacy or rights.
- Do not scrape, resell, overload, tamper with, bypass, or reverse engineer the Service or its security features.
- Do not use generated output to mislead others about identity, consent, endorsements, facts, or real-world events.
10. Service Changes and Restrictions
We may update, suspend, limit, remove, or discontinue any part of Atart at any time. We may also restrict or terminate access if we believe a user has violated these Terms, created risk, or misused the Service.
11. Disclaimers
Atart is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, specific creative results, accuracy of generated output, or suitability for any particular purpose. Your use of the Service is at your own risk.
12. Limitation of Liability
To the fullest extent permitted by law, Atart and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, service interruption, or claims related to user content or generated output.
13. Indemnification
You agree to defend, indemnify, and hold harmless Atart and its operators from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of another person's rights.
14. Updates to These Terms
We may revise these Terms when the Service, policies, or legal requirements change. The updated version will show a new "Last Updated" date. Continued use of Atart after changes are posted means you accept the revised Terms.
15. General Provisions
If any part of these Terms is found unenforceable, the remaining sections will continue to apply. Our failure to enforce a right is not a waiver. These Terms and the Privacy Policy form the agreement between you and us for Atart.
